Insolvency
Malene is the managing partner within the insolvency practice area. In addition to being responsible for the insolvency team at Penta Advokater, Malene advises companies, members of management, creditors, etc. on matters relating to bankruptcy, restructuring, reorganisations and distressed businesses.
Malene is regularly appointed as trustee in bankruptcy and restructuring administrator and also assists Penta Advokater’s other lawyers in such cases. She further advises companies, creditors, financial institutions and public authorities on matters concerning bankruptcy estates, clawback actions, liability assessments and dispositions made prior to bankruptcy.
In addition to her practical advisory work, Malene is highly engaged in the development and dissemination of insolvency law. She regularly lectures lawyers on insolvency-related topics as part of continuing legal education and contributes to the professional debate through articles in legal journals and similar publications.
Malene is a certified insolvency lawyer and is listed on the Danish Debt Agency’s panel of insolvency lawyers.
Disqualification from Management (Bankruptcy Quarantine) and Management Liability in Insolvent Companies
Malene has extensive specialist knowledge in cases concerning disqualification from management (bankruptcy quarantine) and regularly advises directors, board members and owners who are at risk of, or subject to, such disqualification. Malene has developed a digital portal containing all known and published cases on bankruptcy quarantine, giving her in-depth insight into the relevant case law.
Malene lectures lawyers and other professionals on bankruptcy quarantine cases and their handling, viewed from both the perspective of the bankruptcy estate and the affected management.
Furthermore, Malene has handled a large number of cases concerning management and board liability, particularly in connection with distressed companies and/or bankruptcy. She works strategically within this field and has a clear professional ambition to be among Denmark’s leading legal experts in bankruptcy quarantine cases and management liability in insolvent companies.
Criminal Cases Involving Financial Crime
Malene has extensive knowledge and experience in handling criminal cases involving financial crime. She represents clients in matters relating to, among other things, fraud, breach of trust, embezzlement, general liability offences, tax and VAT fraud, bankruptcy-related criminal cases, as well as other matters at the intersection of criminal law and commercial law.
She has significant experience navigating complex cases involving financial crime and liability, where public authorities, law enforcement, trustees and creditors are involved, and where qualified legal advice is essential.
In 2022, Malene was granted her right of audience as defence counsel, entitling her to act as defence lawyer in criminal cases, including cases involving financial crime.
